3. which of your data do we process?
We, digitalSee GmbH (hereinafter referred to as digitalSee), process the following personal data:
– Name and address
– Date of birth
– Telephone numbers (if available landline and mobile)
– and – if available – e-mail address
– Curriculum vitae, cover letter, references
4. for what purpose do we process your data?
digitalSee processes personal data (hereinafter referred to as “data”) of applicants. The data is processed in order to process and respond to your application and, if necessary, to arrange an interview with you. We reserve the right to keep your application on file so that we can come back to you for other jobs in our company that may be suitable for you. Please note your right of withdrawal (see below).
5 On what legal basis do we process your data?
The legal basis is Art. 6 I lit. b) GDPR (performance of contract) and Art. 6 I lit. f) GDPR (legitimate interest) in order to fulfill our obligations arising from the job advertisement on the one hand and to recruit and hire qualified specialists to realize our corporate purpose and maintain our business operations on the other.
Finally, partial processing is carried out in all cases beyond the above purposes on the basis of Art. 6 I c) GDPR (legal obligation) if we need this in order to carry out or prove a fair application procedure and to comply with our tax and commercial law obligations and retention periods.
6. do we pass on your data to third parties?
We may transmit your data to our tax office as part of our bookkeeping if we have reimbursed you for travel expenses, for example. Our legitimate interest in this is effective and competent accounting by specialists and streamlining of administrative work within our company within the meaning of Art. 6 I lit. f) GDPR. Furthermore, the data contained in our accounting may be transmitted to the tax office. This is done to fulfill our legal obligations, so the legal basis for this is Art. 6 I lit. c) GDPR.
7 How long do we store your data?
The retention period or storage period is limited. We delete all data after 6 months at the latest with the following restrictions:
– We can only delete your data as soon as the retention periods under tax and commercial law have expired.
– We may need your data for a longer period of time to safeguard our legitimate interests within the meaning of Art. 6 I lit. f) GDPR in order to assert or defend against any legal claims between us in connection with the relationship between the job seeker and the potential employer.
– If you object to the use of your data, we will immediately restrict the use of your data and delete it unless we still need to retain it for other reasons (see above).
8 What rights do you have?
a) Right to information
You have the right to request confirmation as to whether personal data concerning you is being processed by us and the right to information about your personal data processed by us in accordance with Art. 15 GDPR.
b) Right to rectification
You have the right to rectification, but also completion, of your data in accordance with Art. 16 GDPR.
c) Right to erasure
You have the right to immediate deletion of your personal data (“right to be forgotten”) in accordance with Art. 17 GDPR,
– if they are no longer required,
– if you have objected to processing,
– if you have objected on grounds relating to your particular situation and our legitimate interests do not override yours,
– if the data are processed unlawfully,
– erasure is necessary for compliance with a legal obligation.
d) Right to restriction
You have the right to restrict the processing of your personal data in accordance with Art. 18 GDPR,
– if you contest the accuracy of your personal data and while we verify the accuracy of your personal data,
– if the processing of your personal data is unlawful,
– if your data is no longer required by us, but you need it to assert, exercise or defend legal claims,
– if you have objected to the processing of your data and it is still unclear whether our legitimate interest prevails.
e) Transferability
You have the right to data portability in accordance with Art. 20 GDPR.
f) Revocation in the case of processing based on consent
If we process your personal data for certain purposes on the basis of your consent, you have the right to withdraw your consent at any time with effect for the future.
g) Right of objection
You have the right to object to the processing of your personal data if the processing is based on our legitimate interests and there are grounds relating to your particular situation. In the case of direct marketing measures, you have this right to object at any time and without restriction, see also section 9 (“Information on your right to object”).
h) How do I exercise my rights?

i) Right of appeal
You also have the right to lodge a complaint with a supervisory authority, in particular with the State Commissioner for Data Protection of Lower Saxony, who is responsible for us:

9. information on your right to object
Right to object to direct marketing
If your personal data is processed for the purpose of direct marketing, you have the right to object at any time to the processing of personal data concerning you in accordance with Art. 21 II GDPR.
Right to object to processing based on legitimate interests
If we process your personal data based on legitimate interests, you also have the right to object to such data processing on grounds relating to your particular situation.
